The process includes two steps, which are titled “Category 1” and “Category 2”. We are able and willing to assist at any point of your claim. If you are starting from the beginning, or if you have already started on your own, we will assist you in applying to make sure your claims are submitted properly.
We understand that this is YOUR settlement claim, so we will go at your speed. We will never ask you to talk about anything you feel uncomfortable sharing. Our job is to assist, not to take over.
We do not charge for our services and will NEVER ask for money. The government of Canada pays lawyers a lawyer fee of 5% of your claim, on top of what you receive. So you will always receive your full amount.
How we can help with your claim:
Category 1 Claim Forms
Category 1 requires a class member’s personal information, such as Name, Date of Birth, Mailing Address, etc. This first step also asks for information to determine if you are eligible for the settlement. The forms ask if you were placed in a private home for the purpose of going to school between 1951-1992. You will also need to include the years you were placed in a home, the location of the homes, and the schools you attended. We can assist you in completing this form and submitting your claim. If you qualify, Category 1 pays class members a $10,000 settlement.
Category 2 Claim Forms
Category 2 is an optional and on top of Category 1. It will be processed after you have been approved for Category 1. This set of forms will ask you about any “Abuse” you faced while in the boarding home program.
Our lawyers’ experience helps to tell your story of what you experienced so that you are applying for the level of compensation you deserve based on this settlement. Compensation can range from an additional $10,000 - $200,000 based on the individual’s experience.
Reconsideration / Appeal
You will have the right to apply for reconsideration or appeal your decision after the claims administrators have processed your claims. If you receive a notice for reconsideration please get in touch with us and we can help evaluate why you have received this and what your options are. Even if we did not assist with your claim, we are able to assist with the reconsideration or appeal process.
